ABOUT THE COURSE

The Ligamen case appears in the Documentary Department more often than any other Impediment. The first marriage (which is the prior bond) is shown to be a valid marriage. Therefore, the second marriage is invalid (c. 1085 §1), but must be adjudicated as null (c. 1085 §2). The party with no prior valid marriage bond, who has not been a party to the first marriage, can then marry again. Other typical tribunal cases attempt to show that a given marriage is legally bad. The ultimate goal of this tutorial is to explain the unique situation in which the canonist argues that the first marriage is legally good.
